He had walked down the trail which Constable Krivenko had so painstakingly followed, and later he had returned to the bunkhouse and back to bed. Apparently by this method, he sought to destroy the net of circumstantial evidence that was being woven around him. Sergeant Nelson and Corporal Potterton realized what the old man was trying to do, and continued their investigations. Was the old man telling the truth when he said that he had gone to the cafe for a cup of coffee? This question was soon answered by Sue Dong, one of the proprietors of the Pacific Cafe of Vernon. He told the off- cers that the accused worked for him, and that on the evening of August 4th, 1944, the accused had gone home about 8:30 p.m. after finishing his day’s work, and the ac- cused had not returned to the cafe as he had claimed in his statement. On August 9th, a charge was laid against Won Fat and he was taken into custody for the crime of arson. On August 14th the accused appeared before William Mor- ley, Esq., Police Magistrate for the City of * Vernon, on a preliminary hearing to de- termine whether or not the accused should be committed for trial to a higher court. After hearing the evidence of a number of witnesses the accused was committed to the next court of competent jurisdiction for trial. CIRCUMSTANTIAL EvIDENCE STRONG The trial was held in the County Court Judges Criminal Court before His Honour Judge James Ross Archiebald on August 29th as the accused had elected for a trial ey a jury. The evidence produced by the Crown fitted together like pieces in a jig-saw puzzle. First the young lady who had discovered the fire was able to fix the time accurately, then the Fire Chief and Constable Krivenko told of their investiga- tion, and Constable Krivenko recited what had occured in the Chinese bunkhouse, and that the accused had stated definitely he had not left his bed since 10 p.m. the night be- fore, but on withdrawing the bed clothes the old man was found to be wearing a pair of black trousers. Evidence was also given by the lady who had been annoyed by the ac’ cused, and by Sergeant Nelson and Cor- poral Potterton as well as a number of other witnesses. The Crown showed that the pattern on the rubbers, which were pro- duced as an exhibit, had been worn in many places, and that the pattern on the photo- graphs which were produced coincided ex- actly with the rubbers, even to the extent that a small particle of matter which ad- hered to the bottom of one rubber, showed its imprint in the poorest of the foot- print. It was also proses that one of the footprints was found close to the scene of the fire pointing towards it, and that the same footprints were observed at the gar- bage box which contained material identical to that used in setting the fire. The evi- dence of matches being found with the accused which were similar in all respects to those found at the scene of the fire rounded out the circumstances proved by the Crown.
