The “hardest” man I ever had was Charley Phillips 14 or Benton from the American side in the Okanagan, who served 12 years in Walla Walla Penitentiary for the murder (or perhaps the jury called it “the manslaughter”) of a policeman in Seattle. His father was white, his mother a half breed and he came from Oroville, Washington. His sister was col- lege educated and he could have had the same, and got a good start in life, but he didn’t want education. He got in with a bad crowd of young fellows and of course it doesn’t take much to start a breed going to the bad. He went from bad to worse and did time in Washington for various offences and got in bad with the police over there generally. He told me “if all police officers were like you constables in British Columbia I would be an honest man.” He also did time in Kamloops gaol and was put in Westminster Penitentiary for rape. Charley Rose, a Cariboo half breed met him there, and they struck up an acquaint- ance that served Phillips afterwards. When Phillips was let out of the peni- tentiary he went to Seattle, got into some trouble with the police, ran down a chute at the coal bunkers, jumped into the salt chuck and hung on by his hands to a pile. Coming along with lights the police saw a hand and shot the right hand off and cap- tured him. He had killed the fellow who was taking him to gaol. In those days the sidewalks in Seattle were high above the gullies in some places, and as he was being taken along one of these up-standing side- walks Phillips suddenly broke away and jumped down. They found the marks where he had run along a little ways and hid behind one of the trestles the sidewalk rested on and while the policeman was look- ing for him Phillips shot him. He had not been handcuffed or searched. Patrolman Wells was the policeman he shot dead from ambush and afterwards they got him, as I say. He served 12 years for it. Finally he sawed himself out. Charley went back to his old stamping ground along the boundary between Wash- ington and British Columbia. He knew every foot of that country, all the trails, and the Indians and half breeds sheltered and shielded him, some from sympathy and others from fear. The few white settlers in that part of the State had little to do with him for he was looked upon as an ugly customer and was known to be a dead shot A good deal of his trouble then, as it had been earlier, came from getting his eye on somebody else’s wife or girl.
