Museum The Birds of British Colum- bia is on its way to becoming a Canadian best seller before it's even printed. Birdwatchrs and sportsmen throughout the province have reacted enthusiastically to the pre-publication offer given by the Friends of The Royal Brit- ish Columbia Museum, a non-profit organization funding the produc- tion of this book. The sale has inspired almost 3,000 advance orders from around the province and throughout North America, and has succeeded in providing funds necessary for the initial print run. Friends’ vol- unteers are busy trying to keep ahead of the mail and phone orders. “But there are many more people out there who haven't heard that they can get the book at half-price if they order now," says Wayne Campbell, one of the authors and Curator of Orni- thology at the Royal British Col- umbia Museum. "And what's un- fortunate is that many of these people contributed to the data presented in the book." The six authors, Campbell, Neil K. Dawe, Ian McTaggart-Cowan, John M. Cooper, Gary W. Kaiser and Michael C.E. McNall examined over a million records from near- ly 5,000 contributors throughout B.C. “Our concern," says Camp- bell, “is that some of the con- tributors will not hear of the book until the sale is over." The Birds of British Colum- bia is scheduled for publication in February 1990 and will be available at bookstores for $99.00. Rivers Hinges on Appeal of Nikal Decision SMITHERS - The case of a Moricetown man charged in 1986 with illegal fishing became more significant recently when the B.C. attorney general's office and a commercial fishermen's group joined the federal gov- ernment in appealing the case. Late last month in Terrace, Judge Robert Errico allowed the Attorney Geneal of B.C. and the Pacific Fish Defence Alliance in- tervener status in the federal government's appeal of the Jerry Nikal case. By John Young, The Interior News The appeal was to have been heard October 10 in county court in Smithers, but was adjourned to December 10, 11 andi12to allow the new parties - who applied in- dependently - time to prepare their case, federal Crown pros- ecutor Ron Gamble said last week. In May of this year, prov- incial court Judge David Smyth acquitted Nikal, a Wet'suwet'en, of fisheries Act violations. rul- ing that a Gitkasan-Wet'suwet'en Indian Fishing Bylaw was in effect and superseded the act. The Crown appealed that de- cison on the grounds that Smyth erred in law by recognizing the river bed as part of the reserve. Gamble said the Crown will argue that the federal government - not the Moricetown Band - con- trols the river bed.
