one person engaged in the murder.”

“T do not agree,” Tuohey replied. “One
person could do as much damage in a place
like that as any number of persons. It is,
in fact, a question of proportion, and con-
centration on such a point leads one to
futile guesswork.”

“Did you find those weaknesses in his re-
port before or after you went to investigate
the crime?” Garrett asked smiling.

‘“Before—otherwise I should not have
gone,” Tuohey returned dryly, and then
continued: “Now we come to the question
of the watch. ‘It stopped at 8.3, he states.
‘It was obviously broken in the struggle and
undoubtedly gives the time of the girl’s
death. Now what confusion of thought is
here! Because a broken watch is found on
the dead girl’s wrist he immediately assumes
that it was broken in a struggle which he
states took place prior to the girl’s death
and, without qualification, he goes on to say
that it gives the time the girl died. It was
not ‘obviously’ broken in the struggle. If a
struggle took place at all it might have been
broken before or after that alleged happen-
ing. It ‘undoubtedly’ could not give the
time of the girl’s death merely by the
mechanism stopping at a certain time. To
make this statement a statement of fact,
which the writer endeavours to make it, it
would be necessary to have an independent
fact or witness linking up the breaking of
the watch with the actual time of the girl's
death. Obviously he should have put for-
ward this as a hypothesis. But we better
move on. Turn now to the next page and
read the officer’s following report.”

“Did the technical experts do any good?”
Garrett asked as he turned the paper.

“They did,” Tuohey replied. “They took
some very fine photographs and they found
half a dozen prints that might have belonged
to any one of a dozen persons from the
nearby village who admitted that they had
been at the scene since the finding of the
body. You need not read all that statement
unless you wish to go over again a good
part of the one you have just read, Just read
at the places which I have marked in pencil.”
