Inspr. Barber then instructed them to shoot to kill. Hearing the Inspector’s voice must have had a psychological effect on Smaaslet; he dropped his gun. Owing to the density of the underbrush from where the Inspector stood, he could not see the fugitive, neither could Smaaslet see the Inspector and it was not until the Inspector spoke did he realize there were more than two men at that point and he never, at any time, realized there was a dog tracking, as a Doberman Pincher never _ gives tongue; they work in absolute silence. As they snapped the manacles on his wrist he looked wildly around and asked, “Where is Wales?” “He is back of us in the woods,” he was told. “Please,” he pleaded fervently, “don’t let him touch me. Don’t leave me alone with him.” The pitiful figure was taken back to Barkerville. Later in the summer he appeared before County Court Judge J. O. Wilson at Ashcroft and was sentenced to seven years for attempted gaol break, and ten years for attempted murder. The sentences are to run concurrently. And that closed the Smaaslet case.
