make a swift trip to the Coast in an endeavor to have the evidence ready for the session of the Assize Court at its opening on May 26. Crown Prosecutor IT. W. Brown of Prince Rupert and Sergeant Henry were present at this meeting in Topley, and urged Lashmar to use all speed in getting down to Victoria. Taking the night ‘plane from Prince George, Lashmar arrived in Vancouver the same evening and continued to Vic- toria where he was met the follow- ing morning. Detective-Sergeant J. A. Young (now Sub-Inspector) was ready to conduct the work immediately, hav- ing been warned by radio that Lash- mar was on his way. The examina- tion began. First shots were fired from the suspect rifle, the bullets being recovered in a special box packed with cotton wool. Each test shot was carefully removed before the box was used for another test. The ‘evidence’ bullet was then placed on one stage of the compari- son microscope, while one of the test bullets was placed on the other. Carefully the expert rotated the bul- lets until the land and groove en- gravings began to match, then simul- taneously rotating both bullets, he found all the tiny engravings and scratches matched perfectly. Within the day, news of this was flashed to Prince Rupert, sc that Crown Counsel could advise the Defence new evidence would be forthcoming. The next few days Were spent making photographs for presentation to the court. On May 26, 1947, the trial began before Mr. Justice J. O. Wilson in the Prince Rupert Assize Court. As previously indicated, Mr. Brown acted for the Crown, while Henry Castilou, K.C., of Vancouver, ap- peared for Williams. Evidence simi- lar to that given at the preliminary hearing was called, but now sup- ported by the evidence of Det.-Sergt. Young that Williams’ gun had fired the near fatal shot. The defence merely that the accused did not re- member what happened between mile one and mile eight, but on re- gaining his faculties, he saw his companion, Michel, with his (Wil- liams’) rifle attached to his pack- sack. Evidence was also given by some Indian witnesses of the ac- cused’s good character. Deliberating an hour and fifty minutes, the Jury returned a verdict of “Guilty.” On may 29 the Court sentenced the accused to four years in the penitentiary. Later, the accused appealed to the Court of Appeal, which on October 14. dismissed the Motion of Leave to Appeal. Thus ended a case where the per- sistence of a constable coupled with the expert assistance of a ballistics specialist, and a combination of legal and police talent, brought justice to a remote section of our wonderful northland.
